Transport and mobility

The transport and mobility sector is undergoing major changes due to the recomposition of the stakeholders (organising authorities, private companies), the scarcity of natural resources, growing environmental concerns and the decrease in public funding. Our sector expertise allows us to approach the sector in a transversal way both in terms of advice (contracts, regulations, public and private domain, public procurement, PPP, concessions, financing, accounting and tax structuring) and litigation. Our approach combining public and private law is an asset for dealing effectively and appropriately with issues related to rail, land, air, sea, river and port transport, new forms of mobility, border control and international trade.

 

Areas of intervention

Financing

We support our clients in the financing of infrastructure projects, whether trains, metros, or electric mobility solutions, with specific expertise in EVSE and TIRUERT projects.

Data

Data management in the mobility sector is a major challenge. We advise our clients on data protection related to connected solutions and new transport technologies.

Contentious

Our lawyers defend companies in litigation concerning the awarding or performance of public contracts (public procurement or concessions) or intellectual property issues, in particular trademarks and patents.

International arbitration

We are involved in international arbitrations relating to large-scale infrastructure projects, such as railways, metro networks or the construction of charging stations (EVSE).

Internal arbitration

Our teams assist clients in the resolution of national disputes relating to joint venture, maintenance or supply contracts in the rail or logistics sector.

ADR & Mediation

Favoring amicable solutions, we use tools such as Dispute Boards or third-party mediation to resolve disputes related to engineering and construction projects (EPC).

Examples of support

We assisted a company developing digital solutions and programs in the drafting of a contract for the installation, maintenance and supervision of an EVSE network implemented for a French municipality.

We supported an investment fund with a long-term debt approach in the structuring of a partnership for the financing of EVSE projects developed by a company specialising in electric vehicle charging in response to a concessional call for tenders.

Our law firm was the first firm to structure the business model of a charging station operator in 2016. Our missions were as follows:

  • Legal and tax advice and assistance on strategic considerations and structuring of their business model: installation on the real estate stock of real estate companies, condominiums, on various private and public land.
  • Drafting of the first matrices of commercial contracts;
  • Regulatory analysis of the business model including the installation of parking canopies and charging stations on private or public sites (recommendations in terms of land management, implementation of construction contracts and purchase contracts with electricity network operators).
  • Financing of the first fleet of projects with the associated bank;
  • Legal and tax structuring of the capital entry of two other contributors.

We advised a renewable energy company on the creation of their branch. Then we assisted the branch with its fundraising and various topics related to the realization of the French Gigafactory of the electric battery for electromobility in cooperation with other mobility players.

We assisted and advised a French private equity fund on the corporate and tax structuring of their investments in electric mobility operators.
