Distressed companies and Restructuring
We assist all types of clients: domestic or international, public or private, operators, investors, industrial groups, manufacturers, or suppliers, in the context of restructuring and rescue operations for companies, as well as related litigation. Our expertise and our ability to directly handle international cases, with the occasional support of our extensive network of good friends abroad (specialized or full-service), allow us to assist our clients across various domains.
Areas of expertise
Prevention of difficulties
We assist companies in the prevention of difficulties by implementing proactive measures. This includes the use of ad hoc mandates and conciliation procedures, which enable credit mediation with creditors. Our goal is to facilitate debt and liability restructuring to avoid cessation of payments and recourse to collective proceedings.
Handling difficulties
In critical situations, we support our clients in managing difficulties by advising on the most suitable procedures, such as safeguard proceedings, judicial reorganization, or liquidation. We help develop safeguard plans, recovery plans, continuation plans, or sale plans to ensure the sustainability of the company or organize its restructuring. We also ensure compliance with directors’ legal obligations to prevent personal liability.
Acquisitions and sales of distressed companies, in bonis or under amicable or collective proceedings
We advise investors and companies on transactions involving the acquisition or sale of assets, companies, and/or receivables related to distressed companies, whether in bonis or under amicable or collective proceedings. Our expertise in distressed M&A enables us to secure these complex transactions. We conduct thorough audits to identify risks associated with collective proceedings, creditors, debt claims, and security interests. We also assist in restructuring companies, groups, or investment funds, particularly underperforming LBOs, by working on credit agreements and liability restructuring.
