Areas of intervention in european law

Pre-litigation procedure

We advise our clients during pre-litigation proceedings before European institutions. This includes managing exchanges with the European Commission to prevent breaches of Community law and avoid the opening of litigation. . We help resolve disputes out-of-court, ensuring compliance with European regulations.

Litigation before national and european union courts

We represent our clients in litigation involving European law issues before national courts and European Union instances. This includes the Court of Justice of the European Union (CJEU), the General Court, and the European Court of Human Rights (ECtHR). We also intervene before international criminal tribunals (ICTs) when transnational issues are at stake.

Regulatory aspects of the european union

We support our clients on the regulatory aspects of the European Union, helping them comply with European directives, regulations, and decisions. We ensure that their activities comply with the European standards to prevent disputes and ensure their development in the European market.

Exemples of support in European law

We organized training sessions for the attention of the board of directors and  the executives of a major player in parking management in France, to raise awareness of competition law in their daily decisions. We provided case studies concerning abuse of dominant position behaviors, anti-competitive agreements (vertical and horizontal), guidelines, and dos and don’ts during competition authority investigations. We assisted this client in a partnership with an electric terminal supplier for vehicles, which raised competition law issues and needed to be analyzed under European block exemption regulations.

In the context of selling pharmaceutical data through IT tools, the client, along with several other companies, was targeted by a competitor’s complaint filed with the Competition Authority for alleged anti-competitive practices. Our client’s headquarters were searched at dawn by the Competition Authority in July 2021. Our firm assisted the client during the search and contested certain measures regarding the seizure of documents protected by professional confidentiality We obtained the removal of certain documents protected by professional confidentiality through an order dated September 20, 2022. An appeal was filed with the Court of Cassation on procedural issues.

We assisted our client in a market investigation conducted by the Competition Authority following a third-party complaint regarding certain behaviors of operators active in the market for publishing and marketing software for the automotive industry in France. The investigation led to various questionnaires from the Competition Authority concerning the definition of the relevant market and market dynamics in this sector in France.

We assisted a French group active in the waste management sector in an investigation conducted by the Directorate-General for Competition Policy (DGCCRF) for allegedly participating in various local bid-rigging agreements in public procurement. This case is atypical as it involves elements of criminal law; the administrator’s liability is at stake.

We assisted a global American hospitality and entertainment company operating resorts for several months in drafting and negotiating a franchise agreement with a French pastry manufacturer regarding the opening of a store in Las Vegas, USA. The agreement has implications for both intellectual property and know-how.
