The result of a collaboration between De Gaulle Fleurance & Associés and Case Law Analytics, LitiDesign is based on an in-depth analysis of several hundred court decisions, assessed using over 70 criteria:

Case Law Analytics’ legal analysts have mobilized their expertise in artificial intelligence to transform a statistical tool initially designed by De Gaulle Fleurance & Associés into a high-performance machine. In this way, LitiDesign anticipates the risks of litigation, while at the same time providing insight into strategies for registering and protecting creations.

LitiDesign follows on from an initial fruitful collaboration between De Gaulle Fleurance & Associés and Case Law Analytics, which gave rise to Litimark®, a solution specialized in quantifying the risk of trademark counterfeiting.

Case study
Imagine a luxury company that has created a bag and accuses another well-known company in the market of copying it. The shape and color are similar, but there are other significant differences. The copied bag was the subject of numerous press articles. Damages of up to 300,000 euros are claimed for this infringement. In order to assess its damages, the plaintiff would provide relevant accounting documents. LitiDesign would indicate the plaintiff company’s chances of success, as well as the average amount of damages likely or unlikely to be awarded. This “objective” data, combined with the litigation experience of the defendant’s lawyer, enables the latter to be advised as to the provision to be made in the accounts and/or to recommend an out-of-court settlement with the opposing party for an amount slightly lower than the average amount of convictions displayed by LitiDesign.
