Patent - Paris Court of Appeal declines pan-European ruling in automotive wheels dispute

  Julien Horn, partner and Carlyne Sevestre, lawyer, held a victory at the Court of Appeals of Paris regarding the geographical scope of the French courts' jurisdiction over the alleged infringement of an European patent made by foreign defendants in France and in several other EU countries.   According to the Paris Court of Appeal, no pan-European decision can be handed down in a dispute between Hutchinson and two competitors. Usually, in principle, a French court can rule on suspected infringement of a European patent in other EU member states.
