Contribution to the French public electricity service (“CSPE”)

A number of disputes have arisen in connection with the Contribution au Service Public de l’Electricité (“CSPE”) for the portion that did not directly finance the development of renewable energies for the years 2009 to 2015.

For the record, in the wake of the decision of the Court of Justice of the European Union (CJEU, 25 July 2018, C-103/17, Messer France), handed down on a preliminary question raised by the Council of State (CE Sect, 22 February 2017, Messer France,reqno. 399115), the latter confirmed that the CSPE could be partially reimbursed in proportion to the part devoted to purposes other than environmental (CE, 3 December 2018req.no. 399115) and for all reimbursement claims prior to 2018.

 

The decree concerning transaction requests was published on October 30, 2020, with the repayment table according to years (from 5.77% for 2012 to 29.45% for 2015).
