De Gaulle Fleurance & Associés welcomed and organised, in collaboration with TheFinTechSchools and Independia conseil, a Masterclass « Governance and BlockChain » on May 3rd and 10th, 2016. The masterclass form enabled a genuine interactivity between the speakers and the audience. Indeed, after a short introduction on the topic’s issues, several workshops were organized, such as roundtables and professional experience exchanges. This masterclass was about BlockChain, a digital evolution requiring to rethink regulation rules and companies’ organizations. Two lawyers, Thibault Verbiest and Anne-Hélène Le Trocquer (De Gaulle Fleurance & Associés), Patrice Bloch (Independia Conseil) and Fabrice Seng (TheFinTechSchools) shared their complementary expertise on this subject. More precisely, among the themes that were discussed, the question of trust was held in relation with BlockChain and the direct need to use regulation and governance in this perspective; which is for now only assured at local levels and requires to be studied at a bigger scale. This masterclass assumed that BlockChain’s regulation could be put under the Autorité des marches financiers’ supervision and/or the Autorité de contrôle prudential et de résolution’s one, or even other authorities depending on the way of using BlockChain; this, in order to ensure a balance between the need of transactions transparency and the protection of personal data. As well, the adaptation of administrative boards to this innovative system was mentioned. Those boards are directly affected by the “blockchainization of organizations” and by artificial intelligence. However, such innovations not only have assets regarding financial yields and efficacy, but also some risks; therefore, there is a need to reconsider the human role within this environment.
